
Opposition party Smer-SD has put forward a draft amendment to the Civil Code allowing people greater freedom in prenuptial agreements when it comes to wealth and assets.
At present the law dictates that all acquired wealth after marriage is equally owned and split between the partners, whereby this can only be changed during the course of the marriage, while under the proposed system the couple would be allowed to agree beforehand.
Smer MPs Marian Kovacocy and Renata Zmajkovicova submitted the draft bill, which would enter into force on 1 January 2012 if given the thumbs at by parliament at the beginning of September. With around 48% of marriages in Slovakia now ending in divorce, it is hard to say if this legislation would increase or lower this figure.
